This album has an interesting history – for starters, the whole Art & Electronics label was a very unique and unprecedented business enterprise, only possible at a certain period at the very end of the USSR. The Soviet state became liberal enough for private entrepreneurship and foreign investors, while the complete lack of centralized supervision and oversight create some truly unique opportunities for managers who were still operating an enormous government organizations, like Мелодия label. That's how Mobile Fidelity Sound Lab, ahead of all major labels and much larger classical record companies, became Melodiya's exclusive distributor in the States through the Soviet/American Joint Venture, and gained access to the Holy Grail of the XX century classical and jazz repertoire – a never-ending vault with tens of thousands master tapes, numerous concerts and studio recordings by Russian and Soviet symphonic maestros and virtuosos.

The chaotic situation on the late-USSR market, which made A&E project possible in the first place, also implied some unforeseen complications. Apparently, not all artists were happy with Melodiya re-distributing their music in the West without clearing rights and paying proper royalties. Instead of focusing entirely on the archival stuff, and thus remaining in the 'safe harbor' of public domain and retired artists and ensembles, MFSL launched a number of contemporary classical releases on Art & Electronics. (Perhaps, they were also assuming that the deal they signed with Melodiya would've covered all copyright clearances 'on the Russian side'). Tchaikovsky's 'Queen of Spades' 3xCD opera, recorded with Hvorostovsky – Arkhipova – Vedernikov and Gosteleradio Large Orchestra in Moscow in 1989, was released right after Dmitri Hvorostovsky had his hugely successful US debut concert at New York's Lincoln Center in March 1990. Philips Digital Classics, who had an exclusive contract with Russian baritone, released Dmitri Hvorostovsky, Rotterdam Philharmonic Orchestra*, Valéry Gergiev* - Tchaikovsky & Verdi Arias CD (his first international album, which also contained an excerpt from Queen of Spades) to coincide with a following US tour. Obviously, Philips Classics were not happy with another label capitalizing on publicity/promotional investments in the ascending Hvorostovsky name, and they sued MCA Classics for over $4 mln. According to the lawsuit, Melodiya never had any rights to distribute Hvorostovsky's recorded material, while MCA paid a mere $20,000 for master tapes and all publishing rights for 'Queen of Spades.'

Unfortunately, the outcome of this lawsuit is unknown. Perhaps, A&E/MCA Classics were able to settle this conflict with Philips and Dmitri out-of-court, since the label remained active for a few more years. Not for very long, though, so most likely the financial consequences must've brought the label to the crisis, and settlement payments were probably colossal. It is also unclear whether 'Queen of Spades' 3xCD was partially revoked/removed from retail due to the copyright legal battle, but the album became a rare collectible these days, up to $250 on eBay and other online auctions.
